PUBLIC HEALTH (ANIMALS AND BIRDS) ORDINANCE - minor amendment

CHAPTER 139

PUBLIC HEALTH (ANIMALS AND BIRDS)

1. The Public Health (Animals and Birds) Ordinance is
amended---

(1)in section 2(1), the definition of 'health officer', by repealing
'Medical and Health Services, the Deputy Director of Medical
and Health Services, any Assistant Director of Medical and
Health Services' and substituting 'Health, the Deputy Director
of Health, any Assistant Director of Health';

(2)in section 3(1)(a) by adding 'importation, landing and
removal,' after 'transhipment,';

(3)in section 4(2) by repealing 'either by land or by sea' and
substituting 'by land, sea or air';

(4)in sections 4, 5, 9A and 9B and the Form in the Schedule, by
repealing 'two thousand dollars' wherever occurring and
substituting '$5,000';

(5)in section 16 by repealing 'one thousand dollars' and
substituting '$5,000'.

2. The Public Health (Animals and Birds) (Animal Traders)
Regulations are amended in regulation 5 by repealing paragraph (5)
and substituting-

(5) The fee for a licence shall be $800 for each calendar
year unless the licence is granted after 30 June in a year in
which case the fee shall be $400. (L.N. 118 of 1974; L.N. 74 of
1988; L.N. 291 of 1988)

3. The Dairies Regulations are amended-

(1)in regulation 2 by repealing 'Public Health and Urban Services
Ordinance' and substituting 'Public Health and Municipal
Services Ordinance';

(2) in regulation 8(3)-

(a) by repealing sub-paragraph (a) and substituting---

(a)$2,240; or (L.N. 73 of 1988; L.N. 290 of 1988;
L.N. 400 of 1989)

(b)in sub-paragraph (b) by repealing 'twelve dollars' and
substituting '$56';





(3) in regulation 12-

(a)in paragraph (2) by repealing 'six inches', 'three inches'
and 'one-inch' and substituting 950 millimetres', '75
millimetres' and '25 millimetres' respectively;

(b)in paragraph (3) by repealing 'half an inch' and
substituting 92 millimetres';

(c)in paragraph (4)(a) by repealing 'twelve feeC and
substituting '3.6 metres';
(d)in paragraph (4)(b)(i) by repealing 'eight inches' and
substituting '200 millimetres';
(e)in paragraph (5)(a)(i) by repealing 'thirty-two square feet'
and substituting '3 square metres';
in paragraph (5)(a)(ii) by repealing 'three hundred and
sixty cubic feet' and substituting ' 10 cubic metres';

(4) in regulation 19(2)(i) by adding after 'minutes'-
or in such other manner as the Director may approve

(5) in regulation 22-
(a) by repealing paragraph (1) and substituting---
(1) No registered dairyman and no person who is
employed in any dairy shall be engaged therein unless he
has been-

(a) (Repealed L.N. 360 of 1982)

(b)immunized, in accordance with such of the
requirements of a notification under paragraph
(2) as apply to him.
(b) in paragraph (2)--
(i) by repealing 'Medical and Health Services' and
substituting 'Health';
(ii) by repealing 'other' where it occurs in the second
place;

(6)in regulation 33 by repealing 'Public Health and Urban
Services Ordinance' and substituting 'Public Health and
Municipal Services Ordinance'.

4. The Poultry (Slaughtering for Export) Regulations are
amended-

(1) in regulation 3 by adding after paragraph (2)--
(3) This regulation shall not apply to carcasses
imported from, or to poultry products derived from
carcasses imported from, a country specified in the First
Schedule.





(2)in regulation 15(2)(b)(i) by repealing 'six feet' and substituting
'1.8 metres';

(3)in regulation 24(b)(i) by repealing 'six feet' and substituting
' 1. 8 metres';

(4) in regulation 31-

(a)in paragraph (2) by repealing 'thirty lumens per square
foot' and substituting '320 lux';
(b)in paragraph (3) by repealing 'fifty lumens per square
fooC and substituting '540 lux';

(5) in regulation 92-
(a)in paragraph (2)(a) by repealing 'forty degrees
FahrenheiC and substituting '5 C;
(b)in paragraph (2)(b) by repealing 'forty degrees
FahrenheiC and substituting '5 C';
(c)in paragraph (3) by repealing 'fifty-five degrees
FahrenheiC and substituting '13 C';
(d)in paragraph (4) by repealing 'forty degrees FahrenheiC
(where it appears twice) and substituting '5 C';
(e)in paragraph (6)(a) by repealing 'four pounds' and
substituting '2 kilograms';
in paragraph (6)(b) by repealing 'four pounds' and
substituting '2 kilograms';

(g)in paragraph (8) by repealing 'forty degrees Fahrenheit'
and substituting '5 C';

(6)in regulation 93(2)(a) by repealing 'seventy pounds of salt to
ten thousand gallons' and substituting '7 kilograms of salt to
10 000 litres';

(7)in regulation 97(1) by repealing 'zero degree Fahrenheit and
substituting '18 C';

(8) in regulation 98-
(a)in paragraph (2) by repealing 'one hundred and eighty
degrees FahrenheiC and substituting '82 C';

(b)in paragraph (10) by repealing 'ninety-five degrees
Fahrenheit and not more than one hundred degrees
Fahrenheit and substituting '35 C and not more than
38 C';

(9)in regulation 99(1)(c) by repealing 'one hundred and twenty
degrees Fahrenheit and not higher than one hundred and fifty
degrees FahrenheiC and substituting '50 C and not higher
than 65 C';





(10) in regulation 108(4) by repealing 'three drachms' and
substituting ' 10 grams';

(11) in regulation 120(e) by repealing 'Public Health and Urban
Services Ordinance' and substituting 'Public Health and
Municipal Services Ordinance'.

5. The Public Health (Animals and Birds) (Exhibitions)
Regulations are amended-

(1) in regulation 4(5)-

(a) by repealing '500 dollars' and substituting '$5,000';

(b) by repealing '250 dollars' and substituting '$2,500';

(2)in regulation 8(4) by repealing '100 dollars' and substituting
'$500'.

6. The Public Health (Animals) (Boarding Establishment)
Regulations are amended in regulation 5(5)-

(a) by repealing '500 dollars' and substituting '$1,800';

(b) by repealing '250 dollars' and substituting '$900.

7. The Public Health (Animals) (Riding Establishment)
Regulations are amended in regulation 5(5)-

(a) by repealing '500 dollars' and substituting '$1,800';

(b) by repealing '250 dollars' and substituting '$900.

8. The Regulation of Movement of Dogs (Consolidation) Order is
amended in the Schedule by repealing item 2.
