PUBLIC HEALTH AND MUNICIPAL SERVICES
1. The Public Health and Municipal Services Ordinance is
amended-
(1)by repealing 'Secretary for District Administration' and
substituting 'Secretary for Home Affairs' wherever it occurs;
(2) in section 2-
(a) by adding after the definition of 'bath'-
'billiard establishment' means any place opened,
kept or used for the purpose of playing billiards,
snooker, pool or similar games; (Added 53 of
1988s.3)
(b) by repealing the definition of 'public billiard saloon';
(3) in section 12(1)-
(a)by repealing the semicolon at the end of paragraph (g) and
substituting a full stop;
(b) by repealing paragraph (h);
(4)in section 27(4) by repealing 'Medical and Health Services'
and substituting 'Health';
(5) by adding after section 55(3)--
(4) Regulations made under subsection (1) may-
(a) empower a health officer to-
(i) permit the importation subject to such
conditions as he may specify of such food as may be
prescribed;
(ii) require any imported food as may be
prescribed to be submitted or made available for
inspection by a health inspector;
(iii) impose any conditions or issue any directions
with regard to such imported food as may appear to
him desirable for the purpose of ensuring that such
food is sound, wholesome or fit for human con-
sumption; and
(b)prohibit the contravention of or non-compliance with
any condition, requirement or direction referred to in
paragraph (a). (Added 7 of 1989 s. 2)
(6) in section 92A-
(a) by being renumbered as subsection (1);
(b) by adding after subsection (1)
(2) For the purposes of subsection (1) 'place',
in relation to a billiard establishment, does not
include premises used wholly for residential purposes
and constituting a separate household unit to which
only persons residing in the premises and their guests
are admitted and where no fee is charged for the
playing of billiards, snooker, pool or similar games.

(7) by adding after section 92A-
Regulations providing for exemption
from section 92A
92AA. The Authority may by regulation exempt any
class or description of billiard establishment from the
operation of section 92A.

(8) in section 105-
(a) by repealing subsection (1) and substituting-
(1) Where, in the opinion of the Authority, any
hoarding, scaffolding or other structure erected solely
for the purpose of exhibiting advertisements is
dangerous, or is likely to become dangerous, by
reason of its construction, wind, rain, dilapidation, its
age or other cause, the Authority shall cause a notice
to be served upon the owner of such hoarding,
scaffolding or other structure, or upon his servant or
agent, requiring him, within such reasonable period
as shall be specified in the notice, to remove such
hoarding, scaffolding or other structure or to do such
work as may he specified in the notice to render the
same safe. (Replaced 11 of 1989 s. 2)
(b)in subsection (2)(b), by adding 'and dispose of any
materials removed in executing any such work,' after
44notice,';
(c) by repealing subsection (3) and substituting-
(3) Where-
(a)the owner of any such hoarding, scaffolding
or other structure, or his servant or agent is
not known or cannot be readily found; or
(b)such hoarding, scafrolding or other structure
is, in the opinion of the Authority, in such
a state that it ought immediately to be
removed or rendered safe,
the Authority may forthwith, whether or not a notice
has been served under subsection (1), remove it or
renderitsafe. (Replaced.l1 of 1989s.2)
(d)in subsection (4), by repealing 'the Authority may recover
any expenses incurred thereby' and substituting-
the Authority may dispose of any materials so
removed and may recover any expenses incurred in
the removal of the hoarding, scaffolding or structure
and in the disposal of the materials
(9) in the Second Schedule by adding at the end-

16. The Hawker (Urban Council) By-laws are amended-
(1) in by-law 2 by adding after the definition of 'fixed-pitch
hawker licence'-
'hawker badge' means a badge issued under by-law 10A;

Hawker badges
10A. (1) On issuing or renewing a licence under
these by-laws the Council shall issue to the licensee a
hawker badge on which is shown the date of expiry of the
licence.
(2) A hawker badge shall cease to be valid on the
expiry, cancellation or termination (whichever is the
soonest) of the licence to which it relates.
(3) A licensee to whom a hawker badge has been
issued shall while he is hawking wear the badge affixed in a
prominent position to his outer clothing such that the
details shown on the badge are clearly visible.
