ESTATE DUTY ORDINANCE - minor amendment

CHAPTER 111

ESTATE DUTY

The Estate Duty Ordinance is amended-

(1)in section 3(1) in the definition of 'applicable Schedule' by
repealing 'means the Sixteenth Schedule' and substituting-

but before the commencement of the Estate Duty
(Amendment) Ordinance 1987 means the Sixteenth
Schedule, and in the case of persons dying on or after the
commencement of the Estate Duty (Amendment)
Ordinance 1987 means the Seventeenth Schedule

(2)in section 6(1)(c), in the first proviso, by repealing '$50,000'
and substituting '$100,000';

(3)in section 7A by adding -, or which of them,' immediately after
'one of them';

(4) in section 10(c) by repealing Iocal or';

(5) in section lOA-

(a)in subsection (1)(b) by repealing 'of ' in the first place
where it occurs and substituting 'or';

(b) in subsection (2)(c) by repealing the full stop at the end
thereof and substituting a semicolon;
(c) by adding after subsection (2)(c)--

(d)property to which subsection (1)(a) applies shall,
if the deceased-
(i) died intestate as to that property; and
(ii) is survived by his spouse,
be deemed to have passed on his death to or for the
benefit of his spouse. (Added 18 of 1986 s. 2)

(6)in section 34(7), the proviso, by repealing 'section 7 of the
Banking Ordinance' and substituting 'section 16 of the
Banking Ordinance';

(7)in section 35(4) by repealing 'Seventeenth' and substituting
'Eighteenth';

(8) in section 43(5) by repealing '(a)' and substituting '(d)';

(9) in the Sixteenth Schedule by adding after 'Ordinance 1982'-

and before the commencement of the Estate Duty
(Amendment) Ordinance 1987





(10) by renumbering the Seventeenth Schedule as the Eighteenth
Schedule;

(11) by adding before the Eighteenth Schedule (as so renumbered)-
