1. The Dogs and Cats Ordinance is amended-

CHAPTER 164

NURSES REGISTRATION

1. The Nurses Registration Ordinance is amended-

(1)in section 2, in the definition of 'Director', by repealing
'Medical and Health' and substituting 'Hospital Services';

(2)in section 3(2)(b), by repealing 'Medical and Health Services'
and substituting 'Health'.

2. The Nurses (Registration and Disciplinary Procedure) Regula-
tions are amended-

(1)by repealing 'the Colony' wherever it occurs in regulations 4
and 9 and substituting 'Hong Kong';

(2)in regulation 11 by repealing 'unless he possesses a Hong Kong
School Certificate or equivalent academic qualifications with
grades or credits in such subjects as the Board may, from time
to time, specify.' and substituting---

CHAPTER 161

MEDICAL REGISTRATION

1. The Medical Registration Ordinance is amended-

(1) in section 2-
(a)in the definition of 'Chairman' by adding before the
semicolon-
and includes any person elected to act as Chairman
under section 3A(4)
(b)in the definition of 'Director' by repealing 'Medical and
Health Services' and substituting 'Health';

(2) in section 3-
(a) in subsection (2)--
(i) in paragraph (f), by repealing the full stop and
substituting a semicolon;
(ii) by adding after paragraph (f)
(g) a lay member to be appointed by the Governor.
(Added 3 of 1988 s. 3)
(b)in subsection (3), by repealing 'or (f)' and substituting
', (f) or (g)';

(3) by repealing section 3A and substituting---

3A. (1) The Chairman of the Council shall-
(a) be elected by the members from amongst themselves;
(b)subject to subsection (5), hold office for 3 years or
until he ceases to hold office as a member, whichever
is the earlier; and
(c) be eligible for re-election.
(2) If the office of Chairman becomes vacant due to
effluxion of time, or as a result of resignation or otherwise, the
Secretary shall convene a meeting of the Council within 3
months of the occurrence of such vacancy for the purpose of
electing a Chairman.
(3) The Secretary shall preside at a meeting held under
subsection (2) until the Chairman is elected and assumes office,
but he shall not have an original or a casting vote.
(4) If the Chairman is unable to perform the functions of
his office for any period due to absence from Hong Kong or
any other reason, the members of the Council shall at a meeting
of the Council elect one of themselves to act in his place for the
duration of that period and notwithstanding any provision in
this Ordinance, the Secretary may, where necessary, convene a
meeting for the purpose of such election.





(5) The Chairman may at any time resign his office by
giving notice in writing to the Secretary.

(4)in section 4(1) by repealing 'Director' and substituting
'Chairman';

(5) by adding after section 20C(2)(c)--

(ca) 2 registered medical practitioners appointed by
the Council after consultation with the Chinese

(1) in regulation 6(1A) by repealing '2 inches by 2 3/4 inches' and '1 1/2

inches by 2 1/4 inches' and substituting respectively '50 x 70 mm'
and '40 x 60 mm';

(2)in regulations 9(1)(b) and (c), (4)(a) and (6) and 22(a) by
repealing 'Director' wherever it occurs and substituting

LEGAL PRACTITIONERS

1. The Accountant's Report Rules are amended-

(1) in rule 3(2) by repealing 'Committee' in the second, third,
fourth, fifth and sixth places where it appears and substituting
therefor 'Council';

(2) in rules 6, 9(2)(b), 10, 11 and 12 by repealing 'Committee'
wherever it appears and substituting therefor 'Council';

(3) in Form 1 of the Schedule, in the address at the end thereof-

(a)by repealing 'Committee' and substituting therefor
'Council';

(b) by repealing 'Union' and substituting therefor 'Swire'.

2. The Solicitors' Accounts Rules are amended in rules 8(2), 9(4),
10(7), 11(1), (3) and (4), and 13 by repealing 'Committee' wherever
it appears and substituting therefor 'Council'.

3. The Solicitors (General) Costs Rules are amended in the Third
Schedule, in item 1, by repealing paragraph (c) and substituting'

(i) for the first 100 pages $3.00
(ii) thereafter discretionary but not exceeding
$3.00 for each page.

4. The Articled Clerks Rules are amended in rule 9(4)--

(a)in sub-paragraph (f) by repealing the full stop and

(g)a period of not less than 1 nor more than 3
months such as may be approved by the Society

BANKING

The Banking Ordinance is amended-

(1)under the long title within the square brackets by adding at the

CAPITAL ADEQUACY RATIO

1. In this Schedule-
'bank' means-
(a)any authorized institution (other than any deposit-taking company the
licence or registration of which is for the time being suspended under this
Ordinance); and
(b)any bank incorporated outside Hong Kong which is not licensed under this
Ordinance, except a bank which is, in the opinion ofthe Commissioner, not
adequately supervised by a recognized banking supervisory authority of the
place in which it is incorporated;
'book value' in relation to any thing means its current book value after deducting
the amount of any specific provision made in the books against a reduction in its
value;

capital base' means the capital base of an authorized institution determined in
accordance with paragraph 3;
'Claims on or claims guaranteed by, authorized institutions in Hong Kong' do not
include any claim on or guarantee by an authorized institution the licence or
registration of which, as the case may be, is for the time being suspended under
this Ordinance;
'Core Capital' means the sum, calculated in Hong Kong dollars, ofthe book values
ofthe capital items listed in paragraph 3(a) to (1);
'debt securities' means securities other than shares or stocks;
' gold bullion' held on an allocated basis' means gold bullion held by a person other
than the authorized institution, to the order of the authorized institution, and
which is separately ascertainable;
guarantee' includes indemnity;
' multilateral development bank' means the International Bank for Reconstruction
and Development, the Inter-American Development Bank, the Asian
Development Bank, the African Development Bank or the European Investment
Bank;
'public sector entity in Hong Kong' means the Mass Transit Railway Corporation,
the Kowloon-Canton Railway Corporation, the Hong Kong Housing Authority
and any body specified by the Commissioner in a notice published in the
Gazette;
' public sector entity of any other Tier 1 country' means an entity which is regarded
as a public sector entity by a recognized banking supervisory authority in the
place in which it is incorporated;
residential mortgage' means a mortgage under which-
(a) the borrower is an individual person;
(b) the principal sum does not exceed 90% of the purchase price or the market
value of the property, whichever amount is the lower;
(c) the debt is secured by a first legal charge on the property;
(d)the property secured by the charge is used as the borrower's residence or as
a residence by a tenant ofthe borrower;
' risk weighted exposure' means the risk weighted exposure of an authorized
institution determined in accordance with paragraph 4;
'Supplementary Capital' means the sum, calculated in Hong Kong dollars, of the
book values of the capital items listed in paragraph 3(g) to (o) calculated in
accordance with that paragraph;





'Tier 1 country' means a country which is a member of the Organization for
Economic Co-operation and Development or a country which has concluded a
special lending arrangement with the International Monetary Fund associated
with the Fund's General Arrangements to Borrow, and also includes Hong
Kong;
'Tier 2 country' means any country which is not a Tier 1 country.

2. The capital adequacy ratio of an authorized institution shall be calculated
as the ratio, expressed as a percentage, of its capital base, determined in accordance
with paragraph 3, to its risk weighted exposure determined in accordance with
paragraph 4.

3. The capital base of an authorized institution shall be determined by taking
the sum, calculated in Hong Kong dollars, of the book values (except in relation to
subparagraph (i), where the difference between the market value and the book value
is to be taken) of-

Category I-Core Capital
(a) its paid-up ordinary share capital;
(b) its paid-up, irredeemable, non-cumulative preference shares;

(c) its share premium account;
(d) its reserves other than those referred to in subparagraphs (e), (g), (h) and (i);
(e) its profit and loss account including its current year's profit or loss;
where the Commissioner determines under section 98(2) that the accounts
of the authorized institution are to be on a consolidated basis, minority
interests arising on such consolidation in the equity of its subsidiaries:
Provided that the amount to be included as Core Capital shall be
determined by deducting therefrom the book value calculated in Hong Kong
dollars of the goodwill of the institution;

Category II-Supplementary Capital
(g) its inner reserves;
(h)its reserves on revaluation of its real property, but not exceeding 70% of
any surplus on revaluation;
(i)its latent reserves (i.e. the difference between the market value and the book
value) determined upon revaluation, of securities listed on the Unified
Exchange or on any exchange referred to in the Securities (Recognition of
Stock Markets) (Consolidation) Notice (Cap. 333 sub. leg.):
Provided that-
(i) the amount of any increase in value to be included shall be limited to
45% of such increase;
(ii) the amount of any diminution in value is deducted;
(j)its general provisions against doubtful debts but not including any
provisions against specific or identified losses and against the diminution in
the value of particular assets:

Provided that the amount included under this subparagraph may not
exceed 1.25% of the risk weighted exposure of the authorized institution
determined in accordance with paragraph 4;
(k)its perpetual subordinated debt where the Commissioner is satisfied that
under the terms of the debt instrument the following conditions are met-
(i) the claims of the lender against the authorized institution are fully
subordinated to those of all unsubordinated creditors;
(ii) the debt is not secured against any assets of the authorized institution;
(iii) the money advanced to the authorized institution is permanently
available to it;
(iv) the debt is not repayable without the prior consent of the
Commissioner;





(v) the money advanced to the authorized institution is available to meet
losses without the institution being obliged to cease trading;
(vi) the authorized institution is entitled to defer the payment of interest
where its profitability will not support such payment;
(l)its paid-up irredeemable cumulative preference shares, that is to say, shares
that are irredeemable or that may be redeemed only with the prior consent
of the Commissioner;
(m)its term subordinated debt, where the Commissioner is satisfied that under
the terms of the debt instrument the following conditions are met-
(i) the claims of the lender against the authorized institution are fully
subordinated to those of all unsubordinated creditors;
(ii) the debt is not secured against any assets of the authorized institution;
(iii) the debt has a minimum initial period to maturity of more than 5
years;
(iv) the debt is not repayable without the prior consent of the
Commissioner:
Provided that-
(A)amounts included under this subparagraph shall be discounted by 20%
each year during the 4 years immediately preceding maturity; and
(B)the total amount included under this subparagraph and subparagraph
(n) shall not exceed in total, 50% of the total of the Core Capital;
(n)its paid-up term preference shares, where the Commissioner is satisfied
that the shares have been issued and remain subject to the following
conditions-
(i) the shares have a minimum initial period to maturity of more than 5
years;
(ii) the shares are not redeemable without the prior consent of the
Commissioner:
Provided that-
(A)amounts included under this subparagraph shall be discounted by 20%
of the original amount each year during the 4 years immediately
preceding maturity; and
(B)the total amount included under this subparagraph and subparagraph
(m) shall not exceed in total, 50% of the total of the Core Capital; and
(o)where the Commissioner determines under section 98(2) that the accounts
of the authorized institution are to be on a consolidated basis, any minority
interests arising on such consolidation in the paid-up irredeemable
cumulative preference shares and paid-up term preference shares of its
subsidiaries:
Provided that the amount to be included as Supplementary Capital shall
not exceed the total of the amount determined as Core Capital,
and by deducting therefrom the sum calculated in Hong Kong dollars of the book
value of-
(A)its shareholding in any company which is a subsidiary or holding company
of the authorized institution, other than-
(i) any shareholding that falls to be deducted under subparagraph (B),
(C) or (D); and
(ii) where the Commissioner determines under section 98(2) that the
accounts of the authorized institution are to be on a consolidated basis, its
shareholding in any subsidiary the subject of such consolidation;
(B)its loans to, shares and debentures issued by, and its guarantees of the
liabilities of, connected companies of the authorized institution (other than
shares that fall to be deducted under subparagraph (D)), where in the
opinion of the Commissioner the institution has made the loans, is holding
the shares or debentures or, as the case may be, has given the guarantees,
other than in the ordinary course of business; and for the purposes of this
subparagraph 'shares' and 'debentures' mean shares and debentures
within the meaning of section 2(1) of the Companies Ordinance (Cap. 32),
and a company shall be treated as a connected company of the institution if
it is a subsidiary or the holding company of the institution, or is otherwise
of a description falling within section 64(1) (b), (c), (d) or (e);





(C)its shareholding in any company in which the authorized institution is
entitled to exercise, or control the exercise of, more than 20% of the voting
power at general meetings of the company; and
(D) its holding of shares, stocks or debt securities issued by any bank unless the
Commissioner is satisfied that the holding is not the subject of an
arrangement in which 2 or more persons agree to hold each others capital
or is not otherwise a strategic investment.

4. The risk weighted exposure of an authorized institution shall be the sum of
all the products achieved by-
(a)taking the book value, calculated in Hong Kong dollars, of each of the
items referred to in Table A in relation to the authorized institution; and, in
relation to each item multiplying that value by the risk weight specified in
Table A in relation to that item; and
(b)taking the principal amount, calculated in Hong Kong dollars, of each of
the items referred to in Table B in relation to the authorized institution;
and, in relation to each item converting that principal amount into a credit
equivalent amount by multiplying the principal amount by the credit
conversion factor specified in Table B in relation to that item, and then
multiplying those credit equivalent amounts by the appropriate risk weight
specified in Table A as if the items to which they relate were on-balance
sheet (Table A) items:
Provided that the value of general provisions not included in the capital base
shall be deducted from the book value of relevant items.

SOCIETIES

1. The Societies Ordinance is amended by repealing 'Secretary for
District Administration' and substituting 'Secretary for Home
Affairs' wherever it occurs.

2. The Societies Rules are amended-

(1) in rule 3 by adding after paragraph (2)-

(3) Where a certificate issued under paragraph (1)(a) or
(b) is lost, defaced or destroyed, the Registrar may, on payment
of a fee of $65, issue a duplicate certificate to the society
concerned. (L.N. 238 of 1988)

(2) by repealing rule 6 and substituting-

6. (1) Any person who wishes to inspect an entry in the
register of registered societies or the register of exempted
societies shall complete a request in accordance with Form 9 in
the Schedule.

(2) The Registrar may decline to accept from the same

in either the register of registered societies or the register of

CHAPTER 139

PUBLIC HEALTH (ANIMALS AND BIRDS)

1. The Public Health (Animals and Birds) Ordinance is
amended---

(1)in section 2(1), the definition of 'health officer', by repealing
'Medical and Health Services, the Deputy Director of Medical
and Health Services, any Assistant Director of Medical and
Health Services' and substituting 'Health, the Deputy Director
of Health, any Assistant Director of Health';

(2)in section 3(1)(a) by adding 'importation, landing and
removal,' after 'transhipment,';

(3)in section 4(2) by repealing 'either by land or by sea' and
substituting 'by land, sea or air';

(4)in sections 4, 5, 9A and 9B and the Form in the Schedule, by
repealing 'two thousand dollars' wherever occurring and
substituting '$5,000';

(5)in section 16 by repealing 'one thousand dollars' and
substituting '$5,000'.

2. The Public Health (Animals and Birds) (Animal Traders)
Regulations are amended in regulation 5 by repealing paragraph (5)
and substituting-

(5) The fee for a licence shall be $800 for each calendar
year unless the licence is granted after 30 June in a year in
which case the fee shall be $400. (L.N. 118 of 1974; L.N. 74 of
1988; L.N. 291 of 1988)

3. The Dairies Regulations are amended-

(1)in regulation 2 by repealing 'Public Health and Urban Services
Ordinance' and substituting 'Public Health and Municipal
Services Ordinance';

(2) in regulation 8(3)-

(a) by repealing sub-paragraph (a) and substituting---

(a)$2,240; or (L.N. 73 of 1988; L.N. 290 of 1988;

employed in any dairy shall be engaged therein unless he

PHARMACY AND POISONS

1. The Pharmacy and Poisons Regulations are amended-

(1) in regulation 19(2)(a)-

CHAPTER 135

MIERCHANT SHIPPING (RECRUITING OF SEAMIEN)

The Merchant Shipping (Recruiting of Seamen) Ordinance is
amended-

(1) in section 17A-

(a) by repealing subsection (1) and substituting-

(1) Whenever the Superintendent has reason-
able grounds for believing that any seaman has, in
Hong Kong or elsewhere-

(a)after the commencement of this Ordinance,
been convicted of any offence involving the
import, export, sale or other dealing in or
with, or possession of any dangerous drug;

(b) been convicted-

(i) of an offence against section 73(2); or
(ii) of an offence against section 3(2) of
the repealed Prevention of Corruption
Ordinance or Part II of the Prevention of
Bribery Ordinance in respect of any matter
or transaction whatsoever, actual or
proposed, in which the Seamen's Recruiting
Office was concemed;

(c) deserted his ship;

(d)neglected, or refused without reasonable
cause, to join his ship or to proceed to sea in
his ship;

(e)been convicted of any offence of such a
nature as to render it desirable that he be
suspended temporarily from service with
foreign-going ships or should cease to serve
on such ships;

(f) while engaged in service with foreign-going
ships, been guilty of misconduct of such a
serious nature as to render it desirable that
he be suspended temporarily from service
on, or should cease to serve on, such ships,
whether or not such misconduct constituted
an offence, and, if the misconduct did
constitute an offence, whether or not the
seaman has been convicted of such offence;
or





(g)without reasonable excuse, failed to comply
with any order, direction, requirement or
request made, given or issued under or for
the purposes of this Ordinance by the
Superintendent or any other public officer,

the Superintendent shall forthwith suspend the
seaman's registration.(Replaced 59 of 1979s.2)

(b) in subsection (2)-
(i) by repealing 'specifying' and substituting 'stating';
(ii) by repealing 'and' at the end of paragraph (a);
(iii) by repealing the full stop at the end of paragraph
(b) and substituting '; and';
(iv) by adding after paragraph (b)-

(c)that if the Superintendent fails to exercise any of
the powers conferred upon him by section 17(1)
or 18(1) or (2) within 3 months after the date of
service of the notice on the seaman under this
subsection, the seaman shall be entitled to have
the case referred to the Authority for a decision if
the seaman so requests. (Added 59 of 1979 s.2)

(c) by repealing subsection (4) and substituting-

(4) A suspension of a seaman's registration
under subsection (1) shall continue in effect until-

(a)the Superintendent exercises in relation to
that seaman any of the powers conferred on
the Superintendent under section 17(1) or
(2) or 18(1) or (2); or

(b)the case is determined by a Board of
Reference under section 28A,

whichever is the sooner. (Replaced 59 of 1979s.2)

(5) Whenever the Superintendent fails to
exercise any of the powers conferred upon him by
section 17(1) or 18(1) or (2) within 3 months after the
date of service of a notice on a seaman under
subsection (2), and the seaman requests that the case
be referred to the Authority, the Superintendent shall
forthwith refer the case to the Authority and serve
notice on the seaman that the case has been so
referred. (Added 59 of 1979 s.2)

(2) by repealing section 19;

(3) by adding after section 28-





28A. (1) If, on the hearing of a case referred to a
Board of Reference by the Authority under section 21
following a reference of the case to the Authority by
the Superintendent under section 17A(5), the Board of
Reference is unanimously satisfied that the seaman has, in
Hong Kong or elsewhere-

(a)after the commencement of this Ordinance, been
convicted of any offence involving the import,
export, sale or other dealing in or with, or
possession of any dangerous drug;

(b) been convicted-
(i) of an offence against section 73(2); or
(ii) of an offence against section 3(2) of the
repealed Prevention of Corruption Ordinance or
Part 1I of the Prevention of Bribery Ordinance in
respect of any matter or transaction whatsoever,
actual or proposed, in which the Seamen's
Recruiting Office was concerned;

(c) deserted his ship;

(d)neglected, or refused without reasonable excuse,
to join his ship or to proceed to sea in his ship;

(e)been convicted of any offence of such a nature as
to render it desirable that he be suspended
temporarily from service with foreign-going ships
or should cease to serve on such ships;

(f) while engaged in service with foreign-going ships,
been guilty of misconduct of such a serious
nature as to render it desirable that he be
suspended temporarily from service on, or
should cease to serve on, such ships, whether or
not such misconduct constituted an offence, and,
if the misconduct did constitute an offence,
whether or not the seaman has been convicted of
such offence; or

(g)without reasonable excuse, failed to comply with
any order, direction, requirement or request
made, given or issued under or for the purposes
of this Ordinance by the Superintendent or any
other public officer,

the Board of Reference may, subject to section 30, exercise
the powers specified in subsection (3).

(2) If, on the hearing of any such case as is referred
to in subsection (1), the Board of Reference is not
unanimously satisfied as to the relevant ground specified in
subsection (1), the Board of Reference shall direct the





Superintendent to withdraw the suspension of the
seaman's registration.

(3) The powers referred to in subsection (1) are-

(a)where the Board of Reference is unanimously
satisfied as to any of the grounds specified in
subsection (1)(a) or (b)-
(i) to direct the Superintendent to remove the
name of the seaman from the register; or
(ii) to direct the Superintendent to withdraw
the suspension of the seaman's registration; and

(b)where the Board of Reference is unanimously
satisfied as to any of the grounds specified in
subsection (1)(c), (d), (e), (f) or (g)-
(i) to direct the Superintendent to remove the
name of the seaman from the register;
(ii) to direct the Superintendent to withdraw
the suspension of the seaman's registration;
(iii) to suspend the seaman's registration for
such further period, not exceeding 24 months, as
it thinks fit; or
(iv) to direct the Superintendent to withdraw
the suspension of the seaman's registration and
issue him with a caution in writing to be of good
behaviour in the future.

(4) in section 32 by repealing subsection (1) and substituting-

(1) A seaman-

(a)whose appeal is referred by the authority under
section 20 to a Board of Reference; or

(b)whose case is referred by the authority under
section 21 to a Board of Reference,

and who is dissatisfied in point of law with a decision of
the Board of Reference on the appeal or case may, within
28 days after the service on him of the statement required
to be served on him by section 27(1) or 31(1), as the case
may be, appeal to a judge of the District Court.

CHAPTER 134

DANGEROUS DRUGS

1. The Dangerous Drugs Ordinance is amended-

(1)in section 2(1), the definition of 'Director', by repealing
'Director of Medical and Health Services, a deputy director of
medical and health services or an assistant director of medical
and health services' and substituting-

Director of Health, Deputy Director of Health or an
assistant director of health

(2)in section 49A, paragraph (a) of the definition of 'reporting
agency director', by repealing 'Medical and Health
Department of the Government, means the Director of
Medical and Health Services' and substituting-

Department of Health of the Government, means the
Director of Health

(3)in the Fourth Schedule, item 18, by repealing 'Medical and
Health Department' and substituting 'Department of Health'.

2. The Dangerous Drugs Regulations are amended-

(1) by repealing regulation 9;

(2)in items 1 and 2 in the Second Schedule by repealing '$100'
and substituting '$500';

(3) by repealing the Third Schedule.

PUBLIC HEALTH AND MUNICIPAL SERVICES

1. The Public Health and Municipal Services Ordinance is
amended-

(1)by repealing 'Secretary for District Administration' and
substituting 'Secretary for Home Affairs' wherever it occurs;

(2) in section 2-

(a) by adding after the definition of 'bath'-

'billiard establishment' means any place opened,
kept or used for the purpose of playing billiards,
snooker, pool or similar games; (Added 53 of
1988s.3)

(b) by repealing the definition of 'public billiard saloon';

(3) in section 12(1)-

(a)by repealing the semicolon at the end of paragraph (g) and
substituting a full stop;

(b) by repealing paragraph (h);

(4)in section 27(4) by repealing 'Medical and Health Services'
and substituting 'Health';

(5) by adding after section 55(3)--

(4) Regulations made under subsection (1) may-

(a) empower a health officer to-
(i) permit the importation subject to such
conditions as he may specify of such food as may be
prescribed;
(ii) require any imported food as may be
prescribed to be submitted or made available for
inspection by a health inspector;
(iii) impose any conditions or issue any directions
with regard to such imported food as may appear to
him desirable for the purpose of ensuring that such
food is sound, wholesome or fit for human con-
sumption; and

(b)prohibit the contravention of or non-compliance with
any condition, requirement or direction referred to in
paragraph (a). (Added 7 of 1989 s. 2)





(6) in section 92A-

(a) by being renumbered as subsection (1);

(b) by adding after subsection (1)

(2) For the purposes of subsection (1) 'place',
in relation to a billiard establishment, does not
include premises used wholly for residential purposes
and constituting a separate household unit to which
only persons residing in the premises and their guests
are admitted and where no fee is charged for the
playing of billiards, snooker, pool or similar games.
(Added 53 of 1988s. 4)

(7) by adding after section 92A-

Regulations providing for exemption
from section 92A

92AA. The Authority may by regulation exempt any
class or description of billiard establishment from the
operation of section 92A.
(Added 53 of 1988s. 5)

(8) in section 105-

(a) by repealing subsection (1) and substituting-

(1) Where, in the opinion of the Authority, any
hoarding, scaffolding or other structure erected solely
for the purpose of exhibiting advertisements is
dangerous, or is likely to become dangerous, by
reason of its construction, wind, rain, dilapidation, its
age or other cause, the Authority shall cause a notice
to be served upon the owner of such hoarding,
scaffolding or other structure, or upon his servant or
agent, requiring him, within such reasonable period
as shall be specified in the notice, to remove such
hoarding, scaffolding or other structure or to do such
work as may he specified in the notice to render the
same safe. (Replaced 11 of 1989 s. 2)

(b)in subsection (2)(b), by adding 'and dispose of any
materials removed in executing any such work,' after
44notice,';

(c) by repealing subsection (3) and substituting-

(3) Where-

(a)the owner of any such hoarding, scaffolding
or other structure, or his servant or agent is
not known or cannot be readily found; or





(b)such hoarding, scafrolding or other structure
is, in the opinion of the Authority, in such
a state that it ought immediately to be
removed or rendered safe,

the Authority may forthwith, whether or not a notice
has been served under subsection (1), remove it or
renderitsafe. (Replaced.l1 of 1989s.2)

(d)in subsection (4), by repealing 'the Authority may recover
any expenses incurred thereby' and substituting-

the Authority may dispose of any materials so
removed and may recover any expenses incurred in
the removal of the hoarding, scaffolding or structure
and in the disposal of the materials

(9) in the Second Schedule by adding at the end-

16. The Hawker (Urban Council) By-laws are amended-

(1) in by-law 2 by adding after the definition of 'fixed-pitch
hawker licence'-

'hawker badge' means a badge issued under by-law 10A;

Hawker badges

10A. (1) On issuing or renewing a licence under
these by-laws the Council shall issue to the licensee a
hawker badge on which is shown the date of expiry of the
licence.





(2) A hawker badge shall cease to be valid on the
expiry, cancellation or termination (whichever is the
soonest) of the licence to which it relates.

(3) A licensee to whom a hawker badge has been
issued shall while he is hawking wear the badge affixed in a
prominent position to his outer clothing such that the
details shown on the badge are clearly visible.

4. The Building (Escalators) Regulations are amended by adding
after regulation 3-

3A. Save insofar as provision is made therefor in these
regulations, every escalator and any machinery, mechanism,
electrical installation or equipment connected or associated
therewith shall be designed and installed or constructed, as the
case may be, in accordance with the current relevant British
Standard Code of Practice or Specification and any other
national standard as may be approved by the Building
Authority.

5. The Building (Planning) Regulations are amended-

(1) by repealing regulation 3 and substituting-

3. (1) Every balcony and verandah of more than
600 mm above ground level shall have a protective barrier
along the outer edge not less than 1 100 nun high, and the
lowermost 150 mm of such barrier shall be built solid.

(2) Protective barriers provided under paragraph (1)
shall be so designed as to minimize the risk of persons or
objects falling, rolling, sliding or slipping through gaps in
the barrier, or persons climbing over the barrier.

(3) Every balcony projected from an upper storey of
a building shall have a clear height, upwards from the floor
of such balcony, of not less than the clear height of the
storey from which it projects.

3A. (1) Every opening placed on an external wall
above the ground floor of any building shall be protected
by a barrier which shall be not less than 1 100 mm high
and the lowermost 150 mm of such barrier shall be built
solid.

(2) A barrier provided under paragraph (1) shall be
so designed as to minimize the risk of persons or objects
falling, rolling, sliding or slipping through gaps in the
barrier, or persons climbing over the barrier.





(2) by repealing regulation 16;

(3) by repealing regulation 19 and substituting-

19. (1) Where a site abuts on a street not less than
4.5m wide or on more than one such street the maximum
site coverage permitted in respect of a building or
buildings to be erected thereon shall be determined in
accordance with regulation 20 and the permitted plot ratio
of such building or buildings shall be determined in
accordance with regulation 21.

(2) Where a site abuts on a street less than 4.5 m
wide or does not abut on a street, the height of any
building or buildings to be erected thereon and the
maximum site coverage and plot ratio to be permitted in
respect of such building or buildings shall be determined
by the Building Authority.

(4) by repealing regulation 19A;

(5)in regulation 20 by repealing 'regulations 19A and 22'
wherever it appears and substituting 'regulation 22';

(6)in regulation 21 by repealing 'regulations 19A and 22' in the
two places where it appears and substituting 'regulation 22';

(7) in regulation 22(1)-

(a) by repealing '5 m' and substituting '5.5 m',

(b) by repealing 'build' and substituting 'build;

(8) in regulation 23-

(a) by repealing paragraph (1) and substituting-

(1) For the purposes of regulations 20, 21 and
22, the height of a building shall be measured from
the mean level of the street or streets on which it
fronts or abuts being a street or streets not less than
4.5 m wide, or where the building abuts on streets not
less than 4.5 m wide having different levels, from the
mean level of the lower or lowest of such streets, to
the mean height of the roof over the highest usable
floor space in the building.

(b) by repealing paragraph (3) and substituting---

(3)(a) Subject to sub-paragraph (b), for the
purposes of regulations 19, 20, 21 and 22, the
gross floor area of a building shall be the area
contained within the external walls of the
building measured at each floor level (including
any floor below the level of the ground), together





with the area of each balcony in the building,
which shall be calculated from the overall
dimensions of the balcony (including the
thickness of the sides thereof), and the thickness
of the external walls of the building.

(b)In determining the gross floor area for the
purposes of regulations 20, 21 and 22, the
Building Authority may disregard any floor
space that he is satisfied is constructed or
intended to be used solely for parking motor
vehicles, loading or unloading of motor vehicles
or occupied solely by machinery or equipment
for any lift, air-conditioning or heating system or
any similar service.

(9) in regulation 24-

(a) in paragraph (1)--
(i) by repealing 'of' and substituting 'of not less
than 2.5 m measured from floor to ceiling:';
(ii) by repealing sub-paragraphs (a) and (b);

(b) by repealing paragraph (3).

6. The Building (Standards of Sanitary Fitments, Plumbing,
Drainage Works and Latrines) Regulations are amended-

(1) in regulation 34(2) by repealing ', asbestos cement';

(2) in regulation 91 by repealing', with the consent of the Water

Regulations,'.

7. The Building (Ventilating Systems) Regulations are amended in

CHAPTER 119

CREDMUNIONS

1. The Credit Unions Ordinance was brought into operation on
28 February 1970.

2. The Credit Unions Ordinance is amended-

(1) by repealing section 59 and substituting---
59. Notwithstanding any requirement in any rules
made under the Companies Ordinance relating to the
winding-up of companies, no deposit with the Official
Receiver shall be required in respect of a petition under
section 57 or 58.
(Replaced 39 of 1976 s. 2)

(2)in the heading to Part X1 by repealing 'KONG' where it first
appears and substituting 'HONG';

(3) in section 72(1) by adding after 'this section'-
and shall not be used in any other manner except with the
prior approval in writing of the Registrar

(4) by adding after section 72-
72A. (1) Subject to this section, the League may
borrow money for the carrying out of its objects.
(2) No money shall be borrowed by the League save
upon a resolution of its board.
(3) The League may not borrow money so that its
total indebtedness would in consequence exceed 50 per
cent of its total assets.
(4) The League may not borrow money, so that its
total indebtedness would in consequence exceed 25 per
cent of its total assets, except in addition to the board's
resolution, upon a resolution passed by not less than three-
fourths of the members, present and qualified to vote, at a
special meeting of the League called for the purpose or if
sAnctioned in writing by not less than two-thirds of the
total number of the members of the League qualified to
vote.
(5) In this section 'total assets' does not include the
stabilization fund set up under section 72.

STAMP DUTY

The Stamp Duty Ordinance is amended-

(1) in section 38-

(a)in the definition of 'incorporated public officer' by
repealing 'Secretary for District Administration Incor-
porated' and substituting 'Secretary for Home Affairs
Incorporated';

(b)by adding before the definition of 'premises of the Visa
office'-
'premises of the Committee' means any premises in
respect of which the Chief Secretary has issued a
certificate under section 43(3)(a); (Added 36 of
1989s.5)

(2) in section 43(1) and (2) by adding 'of the Committee,' after
'consular premises or premises'3;

(3) in section 43(3)(a)--

(a) by repealing 'and' at the end of subparagraph (iii);

(b) by adding after subparagraph (iii)-
(iv) in respect of premises which are exempt from
taxation under the Privileges and Immunities (Inter-

ESTATE DUTY

The Estate Duty Ordinance is amended-

(1)in section 3(1) in the definition of 'applicable Schedule' by

POST OFFICE

The Post Office Ordinance is amended by adding after sec-

4A. (1) With the approval of the Governor in Council,
the Postmaster General may issue an adhesive charity postage
stamp that bears, in addition to its regular postage
denomination, a denomination signifying a donation of that
amount by the purchaser to the charitable institution identified
on the stamp.

(2) The Postmaster General shall not sell a charity
postage stamp at any place unless a stamp of the same postage
denomination is also available for purchase there.

(3) The Postmaster General may retain from the money
received as the donation portion of the sale of charity postage
stamps an amount equal to the costs related to them and shall
pay the retained amount into the general revenue.

CHAPTER 94

WIDOWS AND ORPHANS PENSION

1. The Widows and Orphans Pension Ordinance is amended-

(1) in section 2A-

(a)by repealing 'Save' from subsection (1) and substituting
'Subject to subsection (4) and save';

(b) by adding after subsection (4)-
(5) In the case of an officer who has elected and
who has subsequently opted under subsections (1)
and (3) of section 8 of the Pension Benefits
Ordinance, salary, in respect of his service from the
material date which is determined for the purposes of
regulation 16(5) of the Pension Benefits Regulations,
means the aggregate of-

(a)the salary of the officer's substantive
appointment or appointments; and

(b)expatriation pay and personal allowances in
place of expatriation pay, if any. (Added
36 of 1987 s. 39)

(6) In the case of an officer whose application
under section 9(2) and (7) of the Pension Benefits
(Judicial Officers) Ordinance (Cap. 401) is approved,
salary, in respect of his service from the material date
which is determined for the purposes of regulation
16(5) of the Pension Benefits (Judicial Officers)
Regulations (Cap. 401, sub. leg.), means the aggregate
of the salary of the officer's substantive appointment
or appointments and personal allowances. (Added
85 of 1988 s. 46)

22. (1) The pension payable to the widow of a
contributor shall cease on her death or remarriage.

(2) If on the cessation under subsection (1) of such
pension there are no pensionable children of the marriage
of the widow with the contributor, such widow shall, for
the purposes of this section, be considered as dead and the
pension payable to her shall lapse.

(3) If on the cessation under subsection (1) of such
pension there are pensionable children of such marriage
such pension shall be continued and paid as provided in
section 21 to such children as if they have no living mother
or stepmother entitled to a pension.

(4) A widow of a contributor-

(a)may, if her husband dies in her lifetime, be paid
the pension which was payable to her before her
remarriage-
(i) where such pension lapsed under sub-
section (2), as from the day next following the
date of the death of her husband; or
(ii) where such pension became payable to the
children of her marriage with the contributor
under subsection (3), as from the date when the
last of such children ceases to be pensionable; or

(b)may, if she becomes entitled to a pension by
virtue of her marriage with her husband, be paid
such pension until the last of such children ceases
to be pensionable, and may then be paid either
such pension or the pension which was payable
to her before her remarriage whichever is the
greater (each pension being, for the purposes of
this paragraph, calculated with the addition of
any temporary increase attaching thereto).

(5) Where under subsection (4)(b) a widow has
become entitled to the pension which was payable to her
before her remarriage, on such pension ceasing to be
payable to her under subsection (1), the pensionable
children of her marriage with her husband shall be entitled
to the pension that would have been payable to her by
virtue of her marriage with her husband.

(6) For the purposes of this section-

'husband' means the husband of a widow of a contributor
by any remarriage;

'pensionable' means eligible for pension.

(8) by repealing section 34;

(9) by adding after section 34-

35. Any officer making contributions under this
Ordinance who-

(a)was not in service under the Government at the
commencement of the Widows' and Children's
Pensions Ordinance but was appointed to such
service thereafter; or

(b)was at the commencement of that Ordinance in
service under the Government on agreement
as defined in section 2 of that Ordinance
(irrespective of whether such service subsequently
becomes pensionable service by refund or
surrender of gratuity); or

(c) (i) was at the commencement of that
Ordinance in service under the Government
on non-pensionable terms otherwise than on
agreement as defined in section 2 of that
Ordinance;
(ii) failed to make an election under section
3(1)(a)(i) of that Ordinance within the time it had
to be made; and
(iii) after commencement of that Ordinance is
appointed to service under the Government on
pensionable terms,

shall cease or be deemed, except for the purposes of
paragraph (i) of the proviso to section 13(1)(a) of that
Ordinance, to have ceased, to make contributions under
this Ordinance from the date of the commencement of the
period in respect of which he makes contributions under
that Ordinance, and a pension to his wife or children (if
any) shall be computed on the basis of the potential benefit
acquired by such contributor at the date of his ceasing to
contribute, or, he shall receive back such contributions as
would have been due to him had he elected to discontinue
being a contributor and had left the public service on the
date of his ceasing to contribute.

36. No person who is. not a contributor before the
commencement of the Widows' and Children's Pensions
Ordinance shall be required or be permitted to become a
contributor under this Ordinance on the day of or after
such commencement.

(10) in Part II of the Schedule by adding after Note 4-





Note 5---Notwithstanding Note 2, 3 or 4, where the amount of the part
of a pension, if any, (including all variations consequent upon
the rise or fall in the amount of any contribution or upon
re-marriage) purchased by contributions falling due on or
before 30 November 1967, when calculated on and in
accordance with the Tables and Instructions set forth in this
Schedule, is less than the amount of any such part calculated
on and in accordance with the pension tables and rules for
calculating pensions in force on 30 June 1959, the difference
between the two amounts shall be added to the registered
pension, if any, as at 30 November 1967, calculated on and in
accordance with the Tables and Instructions set forth in this
Schedule. (Added 7 of 1971 s. 2)

Note 6 Notwithstanding Note 2, 3 or 4, where a pension calculated on
and in accordance with the pension tables and rules for
calculating pensions in force on 30 June 1959 and payable
before 1 December 1967 is greater than it would be if it were
calculated on and in accordance with the Tables and
Instructions set forth in this Schedule, that pension shall
continue to be calculated on and in accordance with the
pension tables and rules for calculating pensions in force on 30
Junel959.(Added 7 of 1971 s.2)

2. The Widows and Orphans Pension (Application) Regulations
are amended in regulation 2 in the definition of 'established office'
by repealing paragraph (b) and substituting-

(b)in case the Pension Benefits Ordinance (Cap. 99) or the
Pension Benefits (Judicial Officers) Ordinance (Cap. 401)
applies, the meaning assigned to it by section 2 of the
Pension Benefits Ordinance;(85 of 1988 s. 47)

CHAPTER 89

PENSIONS

The Pensions Regulations are amended-

(a) in regulation 21-
(i) in paragraph (b), by adding 'together with interest
at a rate to be determined by the Financial Secretary'
before the semicolon;
(ii) in paragraph (c), by repealing 'on leave without
salary unless such leave shall have been granted on
grounds of public policy with the approval of ' and
substituting 'without salary, unless such absence shall
have been approved on grounds of public policy by';

(b) in regulation 26-
(i) in paragraph (4), by repealing subparagraph (d) and
substituting-

(d)the officer's retirement must be necessitated by
the reorganization of the department to which he
belongs in order to efrect greater economy or
efficiency; or (L.N. 352 of 1988)

(e)the officer's retirement must be necessitated by
the public interest; or (L.N. 352 of 1988)

(f)the officer's retirement must be compulsory and
by reason of the exercise by the Government of
disciplinary powers of punishment. (L.N. 352

(ii) by repealing paragraph (7) and substituting---

(7)(a) Unless it shall have been approved on
grounds of public policy by the Governor, any
period during which a non-pensionable officer
shall have been absent from duty without salary
shall not be taken into account for the purpose of
computing the period of service in respect of
which an annual allowance or a gratuity may be
granted under these regulations.

(b)A period during which a non-pensionable officer
is absent from duty without salary shall not be
regarded as constituting a break in service.
