CHAPTER 276

MASS TRANSIT RAILWAY (LAND RESUMPTION
AND RELATED PROVISIONS)

The Mass Transit Railway (Land Resumption and Related
Provisions) Ordinance is amended-

(1) in section 2-

(a)in the definition of 'authorized office?' by repealing
'Engineering Development' and substituting 'Buildings
and Lands';

(b)in the definition of 'Director' by repealing 'Engineering
Development' wherever it occurs and substituting
'Buildings and Lands';

(c) by adding after the definition of 'Director'-

'eastern harbour crossing' means that part of the
railway between the junction of King Yip Street
and Kwun Tong Road in New Kowloon and
Quarry Bay in the Island of Hong Kong;
(Added 6 of 1986 s. 2)

(2) in section 3-

(a)by repealing 'Engineering Development' wherever it
occurs and substituting 'Buildings and Lands';

(b)by adding after 'easements' wherever it occurs 'or
rights';

(3)in sections 10(2) and 29(1), (2) and (3) by repealing
'Engineering Development' wherever it occurs and sub-
stituting 'Buildings and Lands';

CHAPTER 270

MASS TRANSIT RAILWAY CORPORATION

The Mass Transit Railway Corporation Ordinance is
amended-

(1)in section 13 by repealing subsections (2) and (3) and
substituting-

(2) Subject to the provisions of sections 14 and 14A
the profits of the Corporation in any financial year shall be
applied by it in such manner as it may, with the prior
approval of the Financial Secretary, think fit, being a
manner consistent with this Ordinance. (Replaced 61 of
1983s.2)
(3) For the purpose of this section and sections 14
and 14A the profits of the Corporation in any financial
year are the excess of revenue of the Corporation over the
total sum required by it-
(a)to meet the total outgoings of the Corporation
properly chargeable to revenue account; and
(b)to enable the Corporation to make such
provision for depreciation and renewal of capital
assets, bad debts and other purposes, being
provision properly chargeable to revenue
account, as it may reasonably consider adequate.
(Replaced 61 of 1983 s. 2)

(2) in section 14-
(a) by renumbering the section as subsection (1);
(b)in subsection (1) by repealing 'The' and substituting
'Subject to subsection (2), the';

(c) by adding after subsection (1)-

(2) The Corporation shall not exercise its
powers under subsection (1) except with the prior
approval of the Financial Secretary and shall, where
the Financial Secretary, after consultation with the
Corporation so directs-
(a)carry the whole or part of the profits of the
Corporation in any financial year to the
credit of such general or special reserve fund
as the Financial Secretary shall approve; or
(b)pay the whole or part of any sum standing
to the credit of any such reserve fund into the
general revenue.(Added 61 of 1983 s. 3)





(3) by adding after section 14-

14A. (1) Subject to subsection (2), the Corporation
may declare and pay dividends to the Government on the
shares allotted to it under section 10 in the amount of the
whole or part of the profits of the Corporation in any
financial year.

(2) The Financial Secretary may, after consultation
with the Corporation, after taking into account the loan
obligations of the Corporation, direct the Corporation to
declare a dividend in the amount of the whole or part of
the profits of the Corporation in any financial year after
making allowance for-

(a)any sums carried to the credit of a reserve fund
under section 14; and
(b)any accumulated loss disclosed in the balance
sheet of the Corporation at the end of the
financial year prior to the year in which the
dividend is declared,

and the Corporation shall comply with any such direction.

(3) Any dividend declared under this section shall be
paid into general revenue.

(4) No dividend shall bear interest against the
Corporation. (Added 61 of 1983s. 4)

(4) in section 21-

(a) by repealing subsection (1);
(b)in subsection (2) by repealing 'Public Health and Urban
Services Ordinance' and substituting 'Public Health and
Municipal Services Ordinance';

(c) by repealing subsection (4);

(6)by repealing 'Colonial Treasurer Incorporated' wherever

REGISTRATION OF LOCAL NEWSPAPERS

The Registration of Local Newspapers Ordinance is
amended-

(1) in section 2-

(a)in the definition of 'printed document' by adding at the
end thereof---

but does not include-

(a)any document solely intended and solely
used for a bona fide and ordinary com-
mercial, professional, social or adminis-
trative purpose; or

(b)any other document issued or used by any
public body

(b) by adding after the definition of 'proprietor'-

'public body' has the same meaning as it has in
the Prevention of Bribery Ordinance (Cap. 201);
(Added 51 of 1988s. 2)

(2) in section 7 by adding after subsection (1)--

(IA) No local newspaper shall be registered under
subsection (1) by a name which is identical with the name
by which another local newspaper is already registered.

CHAPTER 259

CONSULAR RELATIONS

1. The Consular Relations Ordinance is amended-

(1) by repealing section 1 and substituting-

1. (1) This Ordinance may be cited as the
Consular Relations Ordinance.

(2) This Ordinance shall come into operation on a
day to be appointed by the Governor by notice in the
Gazette, and notices under this subsection may appoint
difrerent dates for difrerent provisions of this Ordinance.
(Replaced 41 of 1971 s. 2)

(2)in section 2(2) by repealing the definition of 'national of the
receiving State' and substituting-

'national of the receiving State' shall be construed as
meaning-

(a)a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or

(b) a British subject; or

(c)a British protected person. (Replaced 80 of
1982s.2)

(3)in section 6(1)(a) by repealing 'citizen of the United Kingdom
and Colonies' and substituting-

British citizen, a British Dependent Territories citizen or a
British Overseas citizen

(4)in section 9(1) by repealing 'Director of Trade, Industry and
Customs' and substituting-

Commissioner of Customs and Excise

2. The Ordinance came into operation on 4 February 1972.

3. The Consular Relations (Privileges and Immunities) (Kingdom
of Belgium) Order is amended in paragraph 3(2) by repealing sub-
paragraph (a) and substituting-

(a) is not-
(i) a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or
(ii) a British subject; or
(iii) a British protected person; and





4. The Consular Relations (Privileges and Immunities) (French
Republic) Order is amended in paragraph 3(2) by repealing
subparagraph (a) and substituting---

(a) is not-
(i) a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or
(ii) a British subject; or
(iii) a British protected person; and

5. The Consular Relations (Privileges and Immunities) (Federal
Republic of Germany) Order is amended in paragraph 3(2) by
repealing sub-paragraph (a) and substituting-

(a) is not-

citizen or a British Overseas citizen; or
(ii) a British subject; or
(iii) a British protected person; and

6. The Consular Relations (Privileges and Immunities) (Kingdom
of Greece) Order is amended in paragraph 3(2), by repealing sub-
paragraph (a) and substituting---

(b) is not-
(i) a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or
(ii) a British subject; or
(iii) a British protected person; and

7. The Consular Relations (Privileges and Immunities) (United
States of Mexico) Order is amended in paragraph 3(2) by repealing
sub-paragraph (a) and substituting---

(a) is not-
(i) a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or
(ii) a British subject; or
(iii) a British protected person; and

8. The Consular Relations (Privileges and Immunities) (Kingdom
of the Netherlands) Order is amended in paragraph 2(2) by
repealing sub-paragraph (a) and substituting---

(a) is not-
(i) a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or
(ii) a British subject; or
(iii) a British protected person; and





9. The Consular Relations (Privileges and Immunities) (Spanish
State) Order is amended in paragraph 3(2) by repealing sub-
paragraph (a) and substituting-

(a) is a Spanish subject; and

(aa) is not-
(i) a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or
(ii) a British subject; or
(iii) a British protected person; and

10. The Consular Relations (Privileges and Immunities) (United
States of America) Order is amended in paragraph 5 by repealing
sub-paragraph (a) and substituting-

(a) is not-
(i) a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or
(ii) a British subject; or
(iii) a British protected person; and

11. The Consular Relations (Privileges and Immunities)
(Commonwealth Countries and Republic of Ireland) Order is
amended in the Second Schedule-

(1)by repealing 'Commissioner for the Government of Australia.'
and substituting 'Consul-General of Australia.'

(2) by adding after 'Agent for Alberta, Canada.'-

Agent for British Columbia, Canada.

Agent for Manitoba, Canada.

12. The Consular Relations (Merchant Shipping) (Republic of
Austria) Order is amended in paragraph 4(a) by repealing sub-
paragraph (i) and substituting-

(i) by or against-

(A)a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or

(B) a British subject; or

(C) a British protected person; or

13. The Consular Relations (Merchant Shipping) (Kingdom of
Belgium) Order is amended in paragraph 4(a), by repealing sub-
paragraph (i) and substituting---

(i) by or against-





(A)a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or

17. The Consular Relations (Merchant Shipping) (Japan) Order
is amended in paragraph 4(a) by repealing sub-paragraph (i) and

(C) a British protected person; or





18. The Consular Relations (Merchant Shipping) (United States of
Mexico) Order is amended in paragraph 3 by repealing sub-

(a) the proceedings are instituted by or against-
(i) a British citizen, a British Dependent Territories
citizen or a British Overseas citizen; or
(ii) a British subject; or
(iii) a British protected person; or

19. The Consular Relations (Merchant Shipping) (Spanish State)
Order is amended in paragraph 4(a) by repealing sub-paragraph (i)

EMERGENCY POWERS (EXTENSION AND
AMENDMENT INCORPORATION)

1. The Emergency Powers (Extension and Amendment
Incorporation) Ordinance is amended in section 2(2), by repealing
'section 10 of the Interpretation Ordinance' and substituting
'section 23 of the Interpretation and General Clauses Ordinance'.

2. The Compensation (Defence) Regulations are amended-

(1) in regulation 4(6)-

(a)by repealing 'commencement of the Landlord and Tenant
Ordinance' and '(Cap. 255.)' and substituting '23rd day
of May, 1947;

(b)in paragraph (a) by repealing 'the said Ordinance' and
substituting 'Part I of the Landlord and Tenant
(Consolidation) Ordinance' and inserting '(Cap. 7)' in
the margin;

(c)in paragraphs (b) and (c) by repealing 'Ordinance' and
substituting 'Part I';

(2)in regulation 4(7) by repealing 'the said Ordinance' and
substituting 'Part I of the Landlord and Tenant
(Consolidation) Ordinance'.

3. The Compensation (Defence) Modification Regulations are
amended in the definition of 'standard rent' in regulation 2 and in
regulation 3(5) by repealing 'the Landlord and Tenant Ordinance'
and '(Cap. 255.)' and substituting 'Part I of the Landlord and
Tenant (Consolidation) Ordinance' and '(Cap. 7)' respectively.

Rectified by the Attorney General under the Revised Edition of the Laws
Ordinance 1965.

1. The Emergency (Deportation and Detention) Regulations are

127. (1) Any person who utters an inflamma-
tory speech shall be guilty of an offence and shall
be liable-

(a)on conviction on indictment, to a fine of
$50,000 and to imprisonment for 10 years;
and

(b)on summary conviction, to a fine of $10,000
and to imprisonment for 3 years.

(2) The owner, occupier and person in charge of
any building, or any part of any building, which is
used for the uttering of any inflammatory speech shall
be guilty of an offence and shall be liable-





(a)on conviction on indictment, to a fine of
$50,000 and to imprisonment for 10 years;
and
(b)on summary conviction, to a fine of $10,000
and to imprisonment for 3 years.
(3) It shall be a defence in any proceedings for
an offence under paragraph (2) if the accused shows
to the satisfaction of the court that he had taken all
reasonable care to prevent the commission of the
offence.
127A. (1) Any person who---
(a)posts up any inflammatory poster in, on or
against any building, vehicle, tramcar, train,
vessel. sign, post or other thing whatsoever
or in or on any place whatsoever;
(b)sticks or fixes any inflammatory poster in,
on, to or against any building, vehicle,
tramcar, train, vessel, sign, post or other
thing whatsoever or in or on any place
whatsoever;
(c)places any inflammatory poster in, on or
against any building, vehicle, tramcar, train,
vessel, post or other thing whatsoever or in
or on any place whatsoever;
(d) displays or exhibits an inflammatory poster,
shall be guilty of an offence and shall be liable on
conviction to a fine of $5,000 and to imprisonment for
2 years.
(2) Any person who paints, daubs, draws,
writes or otherwise inscribes in, on or against any
building, vehicle, tramcar, train, vessel, sign, post or
other thing whatsoever or in or on any place
whatsoever any inflammatory matter shall be guilty of
an offence and shall be liable on conviction to a fine
of $5,000 and to imprisonment for 2 years.
(3) Any person who has in his possession,
custody or control any inflammatory poster shall be
guilty of an offence and shall be liable on conviction
to a fine of $5,000 and to imprisonment for 2 years.
(4) The owner, occupier and person in charge of
any building or place or any part of any building or
place, and the owner of any vehicle, tramcar or vessel,
in, on, to or against which any inflammatory poster is
to his knowledge posted up, stuck, fixed, placed,
exhibited or displayed or in or on which any inflam-
matory matter is to his knowledge painted, daubed,





drawn, written or otherwise inscribed shall be guilty
of an offence and shall be liable on conviction to a
fine of $5,000 and to imprisonment for 2 years unless
he shows to the satisfaction of the magistrate that he
removed or obliterated the inflammatory poster or
inflammatory matter as soon as practicable. or that he
took all practicable steps to prevent the same from
being posted up, stuck, fixed, placed, exhibited,
displayed, painted, daubed, drawn, written or other-
wise inscribed in, on, to or against the building or
place or the part of a building or place or the vehicle,
tramcar or vessel, as the case may be.

127B. For the purposes of regulations 127,
127A and 127C-

'building' includes the whole or any part of any
domestic or public building, arch, bridge, chim-
ney, dock, factory, garage, hangar, hoarding,
office, pier, shelter, shop, wall, warehouse, wharf,
workshop or other structure whatsoever;

'inflammatory matter' means any matter which-

(a)is or contains an incitement to violence or
counsels or encourage disobedience to the
law or is likely to lead to a breach of the
peace whether or not a breach of the peace
actually occurs;

(b)is calculated to promote feelings of ill-will
and hostility between different races or
sections of the population of Hong Kong;

(c)is calculated to cause disaffection amongst
the members of the police force or public
service; or

(d)is calculated to cause disaffection against the
administration of justice in Hong Kong or
disputes the lawful authority of the courts in
Hong Kong;

'inflammatory poster' means any poster or any
photograph or reproduction of any photograph,
whether or not accompanied by any written or
printed matter, or any banner or similar device,
which is or contains inflammatory matter in any
form, shape or manner whatsoever;

'inflammatory speech' means any speech, address,
slogan or words being or containing inflam-
matory matter;





'place' means any place whatsoever, whether or not
the public has access thereto as of right;

'poster' means any broadsheet, handbill, leaflet,
pamphlet, poster or similar thing or the whole or
any part of any written or printed matter being
used as a broadsheet, handbill, leaflet, pamphlet
or poster;

'utter' means make, deliver or broadcast, whether
directly or by means of any mechanical,
electronic or electrical machinery, equipment or
device, including any megaphone, loudspeaker or
loud hailer, and also means publish by means of
any record, tape, wire or perforated roll, so as in
either case to be capable of being heard by the
public;

'vehicle' has the meaning that it has for the purposes
of the Road Traffic Ordinance and also means a
bicycle, cart, truck or barrow.

127C. (1) For the purpose of preventing the
dissemination of any inflammatory matter, any police
officer of or above the rank of inspector, with the
assistance of such other police officers as may be
necessary, may-

(a)enter and search any building or place if he
knows or has reason to suspect that the
building or place or any part thereof is being
or has been used for the uttering of any
inflammatory speech;

(b)stop, board and search any vessel or stop
and search any vehicle if he knows or has
reason to suspect that the same is being or
has been used for the uttering of any
inflammatory speech;

(c)seize, remove and detain any thing
whatsoever if he knows or has reason to
suspect that the same is being or has been
used for or in connexion with the uttering of
any inflammatory speech; and

(d)seize, remove and detain any thing which
appears to him to be or to contain or to be
likely to be, or to contain, evidence of an
offence under regulation 127.

(2) Any police officer of or above the rank of
assistant superintendent may, with the assistance of
such other police officers or other persons as may be
necessary, take such steps or do such things or cause





such steps to be taken or such things to be done as he
considers necessary to ensure that any thing which is
being or has been or may be used for or in connexion
with the uttering of any inflammatory speech is not
capable of being used for the time being.

(3) Any person who interferes with any step
taken or thing done under paragraph (2) or restores
any thing so that it is capable of being used shall be
guilty of an offence and shall be liable on conviction
to a fine of $5,000 and to imprisonment for 2 years.

(4) For the purpose of preventing the
dissemination of any inflammatory poster, any police
officer of or above the rank of inspector, with the
assistance of such other police officers as may be
necessary, may-

(a)enter and search any building or place if he
knows or has reason to suspect that there is
or may be in the building or place or any
part thereof any inflammatory poster;

(b)stop, board and search any vessel or stop
and search any vehicle if he knows or has
reason to suspect that there is therein any
inflammatory poster;

(c)seize, remove and detain or destroy anything
which is or appears to him to be an
inflammatory poster; and

(d)seize, remove and detain any thing which
appears to him to be or to contain, or to be
likely to be or to contain, evidence of an
offence under regulation 127 or 127A.

(5) Any police officer of or above the rank of
inspector, with the assistance of such other police
officers or persons as may be necessary, may remove
or obliterate from any building, vehicle, tramcar,
train, vessel, sign, post or other thing whatsoever or
from any place-

(a)any inflammatory poster posted up, stuck,
fixed, placed, exhibited or displayed in, on,
to or against the same; or

(b)any inflammatory matter printed, daubed,
drawn, written or otherwise inscribed in, on
or against the same,

and for that purpose may enter and search any
building or place or stop and board any vehicle,
tramcar or vessel.





(6) Any police officer may-

(a)break open any outer or inner door of any
building or place which he is empowered by
this regulation to enter and search;

(b)remove by force any person or thing
obstructing any detention, search, seizure,
or obliteration or removal which he is
empowered by this regulation to make;

(c)detain any person found in any building, or
place which he is empowered by this
regulation to search until the same has been
searched;

(d)detain any vessel or vehicle which he is
empowered by this regulation to search until
the same has been searched;

(e)detain any vessel or vehicle until an
inflammatory poster has been removed or
obliterated therefrom; and

remove any person from any vehicle or
vessel while any inflammatory poster is
removed or obliterated.

FIREARMS AND AMMUNITION

1. The Firearms and Ammunition Ordinance is amended-

(1)in section 13(2) by repealing '10 years' and substituting '14
years';

(2) in section 16(2) by repealing '14 years' and substituting 'life';

(3) in section 17(1) by repealing '14 years' and substituting ,life';

(4) in section 18-

(a)in subsection (3) by repealing '14 years' and substituting
'life';

(b) by adding after subsection (3)-
(4) No prosecution for an offence under
subsection (1) shall be instituted without the consent
of the Attorney General but this subsection shall not
prevent the arrest, or the issue of a warrant for the
arrest, of a person for any such offence. (Added 59
of 1984 s. 5)

(5) If in proceedings for an ofrence under
subsection (1) the defendant is acquitted but it is
proved that he is guilty of an offence under section 20
he shall be convicted of the offence under section 20
and shall be punishable accordingly notwithstanding
that there is no consent to prosecute in accordance
with subsection (3) of that section. (Added 59 of

CHAPTER 234

PRISONS

1. The Prisons Ordinance is amended-

(1)in section 2 by adding after the definition of 'disciplinary
offence'-

'hostel' means a building or portion of a building set
aside as a hostel under section 24B; (Added 44 of
1987s.2)

(2) by adding after section 24A-
2411. (1) The Secretary for Security may, by order
published in the Gazette, provide for-

(a)any building or portion of a building to be set
aside as a hostel for the purposes of this
Ordinance;

(b)the discontinuance of the use of such building or
portion of a building as a hostel.

(2) A hostel shall be under the control of the
Commissioner.

(3) A person who is-

(a)required, by any supervision order made under
the authority of any Ordinance, to reside in a
hostel; and
(b)employed outside the hostel under a contract of
service or apprenticeship and remunerated,

may be required to pay such charges in respect of his food
and accommodation in the hostel as the Commissioner,
with the approval of the Financial Secretary, may
determine.

(3)in section 25(1)(a), (c), (d), (de), (g) and (1) by adding 'and
hostels' after 'prisons' wherever it appears;

(4)in section 25(1)(dc)(ia) by adding 'or the Pension Benefits
Ordinance' after 'Ordinance'.

2. The Prison Rules are amended-

(1) in rule 69A-

(a)in paragraph (1) by repealing 'The' and substituting
'Subject to paragraph (28), the';





(b) by repealing paragraph (2) and substituting-

the case of any prisoner who, at the date determined
for the purpose of paragraph (1), is due or is likely to
be due for discharge within 6 months from that date.

Application of rules as to privileges
and remission of sentence

215. (1) A prisoner committed for contempt, or for
failing to do or abstain from doing anything required to be
done or left undone, shall be subject to the special rules
under this Part that apply to prisoners awaiting trial.
(2) A prisoner detained in a prison for a stated term
on committal for contempt, or for failing to do or abstain
from doing anything required to be done or left undone,





shall, for the purpose of rule 69, be treated as serving a
sentence of imprisonment for the stated term.

1. The Police Force Ordinance is amended-

CHAPTER 230

PUBLIC BUS SERVICES

The Public Bus Services Ordinance is amended-

(1)in section 2 by adding after the definition of 'North-west
Transit Service Area'-
'passenger' in relation to a bus means any person carried
in or on it other than the driver or conductor or any
other employee of the grantee who is in uniform and
on duty; (Added 88 of 1988 s. 2)

(2)in section 26 in the definition of 'operating receipts' by adding
after paragraph (b)---
(c)the interest or dividends accruing in respect of cash or
securities which are for the time being deposited by a
grantee with the Director of Accounting Services for
the purposes of section 4(4)(c) of the Motor Vehicles
Insurance (Third Party Risks) Ordinance (Cap. 272);
(Added 88 of 1988 s. 3)

(3)in section 35 by repealing paragraphs (d) and (da) and
substituting-
(d)generally as to the conduct of passengers and in-
tending passengers on buses used by a grantee;
(Replaced 88 of 1988 s. 4)

(4) by adding after section 36-
Further powers in relation to
regulations and by-laws
36A. (1) Any regulations made under section 35 or
by-laws made under section 36 may-
(a)require a passenger or intending passenger to
comply with any reasonable direction given
in the interests of public safety by a driver,
conductor or authorized person;
(b)authorize the removal from a bus of any person
committing an offence against the regulations or
by-laws, as the case may be, by the driver, the
conductor or an authorized person, or by a
police officer at the request of a driver, conductor
or authorized person;
(c)require any person whom a driver, conductor or
authorized person has reasonable grounds to
believe has committed an offence against the
regulations or by-laws, as the case may be, to
give his name and proof of his identity to the
driver, conductor or authorized person;





(d)authorize a driver, conductor or authorized
person to arrest without a warrant and detain
until he can be handed over to a police officer,
any person whom he has reasonable grounds
to believe has committed an offence under the
regulations or by-laws, as the case may be.

(2) Any such regulations or by-laws may-

(a)authorize a police officer, to whom a person has
been handed over under subsection (1)(d), to
take such person into custody without a warrant;
and

(b)apply sections 51 and 52 of the Police Force
Ordinance (Cap. 232) to persons taken into
custody under the regulations or by-laws.

CRIMINAL PROCEDURE

1. The Criminal Procedure Ordinance is amended-

(1)in section 2, in the definition of 'hospital order' by adding
'49,' after '45,';

(2)in paragraph 2 of the Fourth Schedule by adding 'without an
endorsement under subsection (IA) of that section' after 'that
Ordinance';

(3) in the Fifth Schedule-

(ii) in paragraph 3 by repealing 'detention and' and
substituting 'admission for';

2. The Criminal Appeal Rules are amended-

(1) by adding after rule 1-

1A. In these rules, unless the context otherwise
requires-

'shorthand note' means any contemporaneous record of
proceedings in court, whether made by hand or by the
use of any mechanically or electronically operated
device, and whether or not comprising legible
symbols, being a record from which an accurate
legible transcript of the proceedings is, or may be,
made; (L.N. 345 of 1984)

'shorthand writer' means any person who makes by
hand, or operates a device that produces, a shorthand
note. (L.N. 345 of 1984)

(2) in rule 10-

(a) in paragraph(a) by adding after 'proceedings'-

unless, by reason of the nature of the record, it is not
practicable so to do

(b) by repealing paragraph (b) and substituting-

(b)certify any shorthand note taken by him to be

and complete shorthand note of the trial or

CHAPTER 218

TRAVEL AGENTS

The Travel Agents Regulations are amended in the Second
Schedule-

(a) in Form 1-
(i) in condition (1) by repealing 'his' and substituting
'the licensee';
(ii) by adding after condition (1)-

(2) The licensee shall, prior to the expiry of this
licence, submit to the Registrar of Travel Agents the
latest statement of accounts in respect of the licensee's
business as a travel agent.

(3) The licensee shall, during the period that this
licence is in force, be and remain a member of an
approved organization specified in Part I of the
Schedule to the Travel Agents Ordinance (Chapter
218).

(b) in the Chinese version of Form 1, by adding after (1)-


(c)in Form 2, by repealing in note 7 'and a levy of $2,500
under section 13(a) of the Travel Agents Ordinance

(d) in the Chinese version of Form 2, by repealing in


(e)in Form 3, by repealing in note 8 'and a levy of $2,500

shall be liable to imprisonment for life';

(2) in section 42 by repealing '14 years' and substituting 'life';

CHAPTER 192

MATRIMONLAL PROCEEDINGS AND PROPERTY

The Matrimonial Proceedings and Property Ordinance is
amended-

(1)in section 2(1), by repealing the definition of 'court' and
substituting-

'court' means the Supreme Court or the District Court;
(Replaced 79 of 1981 s. 7)

(2) by adding after section 2-

PARTIA

COMMENCEMENT OF PROCEEDINGS

2A. (1) Subject to subsection (2), proceedings under
this Ordinance shall be commenced in the District Court:

Provided that rules of court may make provision-

(a)for the transfer to the Supreme Court of any
proceedings upon the application of any party or
at the instance of the District Court; and

(b)for the transfer and retransfer from the Supreme
Court of any proceedings to the District Court.

(2) Applications under sections 11, 12, 13 and 23
shall be made to the court that made the order to which
the application relates:

Provided that rules of court may make provision for
the transfer of applications from one court to the other.
(Added 79 of 1981 s. 7)

(3) by repealing sections 13(3), 15(3) and 16(3);

(4) in section 23(3)-
(i) by repealing 'to (4)' and substituting 'and (4)';
(ii) by repealing ', and the references to the court in this
section shall be construed in accordance with subsection (3) of
section 13 as applied by this subsection';

(5) in Part III by adding before section 30-





29A. (1) If, at the time of the presentation of a
petition for divorce, nullity of marriage or judicial
separation, there is subsisting an order, made by a court in
previous proceedings between the same persons as are
parties to the petition, requiring financial provision to be
made for the maintenance by one of the parties of the
other, or for the maintenance by either or both of the
parties of a child of the family, the court hearing the
petition may, if it thinks fit, direct that the said order shall
cease to have effect on such date as may be specified in the
direction.

(2) For the purpose of this section 'parties to the
petition' means the petitioner and the respondent.

1. The Maintenance Orders (Reciprocal Enforcement) Ordinance
is amended in section 2(1) in the definition of 'maintenance
order'-

(a)in paragraph (b) by repealing the comma at the end thereof
and substituting '; and';

(b)by repealing 'and, in the case of a maintenance order
which has been varied, means that order as varied;';

(c) by adding after paragraph (b)-

CHAPTER 179

MATRIMONAL CAUSES

1. The Matrimonial Causes Ordinance is amended by adding after
section 54-

54A. For the removal of doubt, the Matrimonial Causes
(Amendment) Rules 1982 made by the Chief Justice under
section 54 of the Matrimonial Causes Ordinance, are deemed
to have been made by the Chief Justice in the exercise of
his powers under that section and under section 32 of the
Matrimonial Proceedings and Property Ordinance and accord-
ingly to be and always to have been valid.
(Added 72 of 1985 s. 2)

2. The Matrimonial Causes Rules are amended-

(1)in rule 98(3) by repealing 'Form 1 and substituting
'Form 15';

(2)in rule 100(4) by repealing 'Form 1 ' and substituting
'Form 15'.
